At the center of this dispute are Nathalie Sainvil Augustin, a Haitian diplomat stationed in Mexico, and Smith Augustin, a former ambassador and current member of Haiti’s Presidential Transitional Council. Now, their conflicting claims—one clinging to the bond of marriage, the other holding firm to an official divorce—have become a national spectacle.
The controversy erupted on May 26, 2025, during the broadcast of Le Rendez-vous on Gazette Haïti News. On air, presidential advisor Smith Augustin confidently stated that he was divorced—an announcement that stunned Nathalie Sainvil Augustin, who maintains that she is still his wife. In response, she retained attorney Me Dalounce Désir, who quickly issued a formal legal warning (sommation) to Mr. Augustin through bailiff Dédier Soigner.
In the formal notice dated June 2, 2025, Ms. Sainvil Augustin “categorically denies any divorce proceedings initiated without her knowledge.” She emphasized that she visited her husband in Haiti as recently as August 2024, and that the couple spent “joyful days together.”
Her position is unequivocal: she does not acknowledge any legal dissolution of their marriage. The letter even demands that Mr. Augustin clarify whether he intends to stand by his public statement—warning of possible legal action if he does not retract it.
However, in an attempt to put the media firestorm to rest, Smith Augustin’s camp produced what they consider irrefutable evidence: the official divorce decree. Dated November 25, 2022, and registered under No. 035662 by Civil Officer Jean Rodrigue Israël, the document confirms that the divorce was legally granted at the request of Smith Augustin by the Civil Court of Port-au-Prince.
Now, the debate hinges on whether the emotional bond claimed by Ms. Sainvil Augustin outweighs the authority of the civil code. Is this a case of love in dispute, or a finalized divorce not yet accepted?
